CIRC 016: PERSONAL EMAILS SENT FROM BUSINESS ACCOUNTS ARE NOT PRIVATE OR CONFIDENTIAL

Following on from an earlier Supreme Court decision in Bloomberg v ZXC, handed down in February 2022, the Court of Appeal have determined that personal emails sent from work accounts are not private or confidential and employers have full access to emails sent via a business account.

A situation where the employer is free to snoop on correspondence with trade union advisors and their solicitors has obvious implications for confidentiality. The National Executive therefore advise that should any Legal paperwork need to be submitted to the POA or Thompsons this should be done using a personal email address.
