As part of the prison reform programme the Secretary of State for Justice empowered Governors with limited autonomy within the provisions of the white paper.

HMPPS issued the POA with an Annex A and the NEC responded setting out areas that we believed were out of scope under empowerment and autonomy. Despite our response and objections some issues remain unresolved.

HMPPS issued guidance in 2017 to Governors covering autonomy which had not been agreed by the POA.

The NEC continue in discussions with HMPPS and seek written assurances on what autonomy local Governors have in respect of staffing, policy and terms and conditions as new strands of work come into force.

The Executive are aware that some Governors have made promises outside of the pay policy manual to members in respect of pay and terms and conditions which they do not have the authority to do.

The provisions to change pay, allowances, or terms & conditions are not within the remit of Governors under autonomy or empowerment. Members need to ensure they seek legal advice if they are considering accepting a change which may affect their terms and conditions and or pay from their Governor.
