Urgent Advice

It has been drawn to the attention of the NEC that more and more members are facing disciplinary action which has resulted in dismissal and/or criminal proceedings for failing to follow the employer’s policies. In addition, member’s health has been affected as a result of the harmful effects of second hand smoke and NPS.

It is the role of the Executive to make members aware of their legal obligations to follow the employer’s policies.

Members have failed to follow the (LSS) local security strategy and as a result faced disciplinary and/or criminal proceedings. Therefore, it is incumbent on all POA members to familiarise themselves with this policy and follow the procedures at all times.
It has also been brought to the attention of the Executive that staff are not following the guidance on opening cell doors where prisoners have been smoking or suspected of smoking contained within PSI 9/2007 interim instruction (attached), and advice from the union as set out in POA Circular100/2015.

Members must ensure they follow this advice to protect their well-being and that of their colleagues and prisoners in their charge.

It is clear from these issues that members are not being advised or aware of the current Risk Assessments and Safe Systems of Work in their place of work. Risk Assessments and Safe Systems of Work are in place to protect employees and prisoners. Members must follow these at all times and ensure that they are reviewed by qualified staff following any change in circumstances or incident.

It is vital that all members are made aware of the contents of this circular and local officials raise this with the local management to ensure all policies are adhered too, Risk Assessments and Safe Systems of Work are up to date and reviewed, the local security strategy and contingency plans published to minimise the risk of members failing to adhere to these at all times.

Thanking you in anticipation of your support and co-operation.

Yours sincerely

General Secretary
