Phil Copple to POA 07 07 16

Thank you for attending Clive House earlier today to discuss the situation following the issuing of POA Circular 60/2016.

It was helpful to understand better your dissatisfactions in relation to recent communications from us and to reform and related issues. I reiterate the commitment of NOMS to engage with the POA properly on issues such as prison reform and the offender management staffing model. Meetings are scheduled next week – on Tuesday afternoon about offender management and on Thursday morning with a range of NEC colleagues – which provide opportunities to progress our engagement on these matters.

Although we did not agree a way forward in respect of the Circular, I said I would write to confirm the NOMS position. The main points are as follows:

 

  • It remains our position that the branch meetings instructed by Circular 60/2016 constitute unlawful industrial action. We cannot respond in ways that legitimise or normalise that action, and which tend therefore to encourage further recourse to it. It is not acceptable to us. On that basis, I urge you to reconsider your position and make best endeavours to communicate your withdrawal of that instruction before 0800 tomorrow.
  • Any staff who do not work normally tomorrow and take industrial action between 0800 and 0900 will have a stoppage of pay. However, in that event we will on this occasion vary the arrangements in NTS 47/2010 and apply a stoppage of 1 hour’s pay. Industrial action of more than 1 hour will attract the usual stoppage of pay provisions in the NTS.
  • I stand ready to make myself available for discussions at any time tomorrow, either on the broader issues we discussed today or on the management of events related to Circular 60/2016.
