PRE-ACTION PROTOCOL LETTER

Following the 28 day improvement notice served on NOMS by the National Executive Committee to ensure the health and safety of our members and those in our care was safeguarded, the NEC have been in discussion with NOMS on a variety of issues including violence, smoking in prisons, NPS and its damaging effects on both prisoners and staff. Of course, this list is not exhaustive and other areas of concern are also being discussed to make the conditions that our members work in safer, as at present they are in their worst state for 10 years.

As part of our strategy we may be embarking on various legal challenges and today Michael Spurr has been sent a pre action protocol letter regarding a Judicial Review on smoking in prisons, which fails to protect our members from secondary smoking. We will keep you updated on developments but the NEC are committed to protecting our members health and safety and will continue to take all steps to ensure the employer is accountable.
