The National Offender Management Services have a policy for Trade Unions that stops a day’s pay and pension even if only half a day is taken in industrial action.

During our pension protest in 2012 NOMS did not commence legal proceedings against the Union. It was brought to our attention that some members had the NOMS policy enacted against them to stop a full day’s pay.

The POA NEC sanctioned funding under our Legal Aid rules a challenge for one of our members. The Court ruled in our members favour and NOMS did not appeal the decision.

The NEC have entered into discussions with NOMS to seek a resolve for any member who suffered a detriment.

At a HR Whitley meeting on 17th December 2015 a commitment was given by NOMS to have a resolution in place by 15th January 2016.

This Circular is to request that all members who have suffered a financial loss of a full day’s pay when they returned to duty before lunch to forward their details to their local committee, who are then requested to collate the details of all affected members with evidence of the detriment and forward the information to Cronin House via email to the Legal Department at legal@poauk.org.uk.
