POA Application to the European Court of Human Rights (ECtHR), "Trade Union Rights"

On the 26th June 2013, the NEC considered the note from John Hendy QC in respect of the POA’s application to the (ECtHR) on Trade Union Rights, which was dismissed on the 21st May 2013.

Our application was deemed inadmissible on the grounds that it covered, essentially the same legal ground as the POA’s complaint to the Committee on Freedom of Association of the International Labour Organisation.

The decision from the EctHR was not handed down to our legal representatives for 14 days and this has resulted in the delay in advising the membership.

Clearly, there are a number of legal arguments, which need to be considered in light of this decision and once the Executive has fully considered the judgement and the note from our legal representatives, further information will be promulgated by way of POA Circular.
