Legal: Pay in Lieu of Notice

It has been drawn to the attention of the National Executive Committee that members have accepted Pay in Lieu of Notice, hence terminating their employment with immediate effect.

Members appear to be under the impression that they still have three months less a day to raise a claim in the Employment Tribunal from the date the notice period would have ended, this is not the case. If any member accepts Pay in Lieu of Notice, their employment ends on the day they accept that offer and the time limit of three months less a day commences immediately.

It is vital that any member who is dismissed for any reason completes the appropriate form from the Legal Advice Handbook and applies for legal advice immediately to ensure that any claim is not “statute barred”. Members should not wait for the outcome of any appeal or for their notice period to come to an end.

It is the members’ responsibility to apply for legal advice on any work related matter and they must ensure any relevant documentation is submitted in a timely manner.
