FINAL OFFER ON CHANGES TO THE SCHEME DESIGN OF THE PCSPS

Glyn Travis, Joe Simpson and Jim Dawson met with Simon Cheetham QC and Jo Taylor from Thompsons in respect of any possible legal challenge, which may be open to the POA on the above issue, following imposition by Government in 2012.

At present there are still outstanding issues which need to be resolved in respect of the Equality Impact Assessment and these will be subject to further consultation with Cabinet Office. Once we are in possession of the final version of the Equality Impact Assessment, Counsel will be instructed to provide his final advice. We have scheduled further meetings in September to obtain Counsels opinion and establish if there are any grounds to conduct a Judicial Review.

At the meeting with Counsel, it was established that there is no legal challenge available to the POA in respect of the increase in contributions under the PCSPS.

Further information will be promulgated in due course to the membership on the merits of any legal challenge and to provide an overview of the scheme changes.
