PSI 6/2010

PSO 8460 was agreed by the POA in 2003.  In 2007 the Prison Service amended PSO 8460 and the amended version of PSO 8460 appears on the intranet.  The POA had no objections to the variation made to PSO 8460 in 2007, as it separates out the penalties for misconduct and gross misconduct.  PSI 6/2010 seeks to revert the penalties back to the 2003 position.

PSI 6/2010 has not been agreed by the POA and was imposed in March 2010 despite our objections.  The POA has since invited the Prison Service to withdraw PSI 6/2010 and meet to negotiate any proposed amendments to the Intranet version of PSO 8460.  The Prison Service is unwilling to withdraw PSI 6/2010.  

In order that we may explore if there is a legal challenge that can be brought on behalf of members who are subject to a disciplinary penalty that is not in accordance with the terms of the  intranet version of PSO 8460, we recommend that the attached statement is read out at the start of any disciplinary investigation/hearing.  If the member is charged with a penalty outside of the terms of the intranet version of PSO 8460 regardless of their objections they should apply for legal advice.
