Addendum to POA Circular 112/2010: Voluntary Re-grading from Senior Officer to Prison Officer

On 1st September 2010 we circulated the clarification received from Jim Heavens, regarding the terms and conditions of those Senior Officers who voluntarily re-grade to the rank of Prison Officer.

Since circulating the letter from Jim Heavens under POA Circular 112/2010, we have received another letter from NOMS informing us that the clarification provided by Jim Heavens is inaccurate, specifically in relation to the payment of specialist allowance.

Not only is it disappointing that the clarification provided by the employer is inaccurate, but the further letter which is attached only serves to cause more confusion.

The further letter from NOMS also raises a number of issues with regards to Prison Officer grades, payment of specialist allowance and pay policy.  In the circumstances, we have written to NOMS seeking further clarification.

We re-iterate that we have not negotiated either position with NOMS.  We have only received correspondence from NOMS after it was agreed they would provide us with clarification of the terms and conditions upon which a Senior Officer, who voluntarily re-grades to Officer will be employed.

In light of the continued uncertainty and confusion caused by NOMS, as to what are the terms and conditions of those staff who voluntarily re-grade from Senior Officer to Officer, those members who have been offered different terms to those set out in either letter received from NOMS, should seek confirmation that their terms will nonetheless be honoured.

We will circulate further clarification received from NOMS when it is received.  However, in the meantime, please draw the contents of this Circular to your members’ attention.
