POLITICAL FUND EXEMPTION NOTICE

Under Section 32A of the Trade Union and Labour Relations (Consolidation) Act 1992 the POA is required to provide the following notices relating to the political fund as set out in the Unions Rules and Constitution which can be found on the POA website at http://www.poauk.org.uk/index.php?rules-and-constitution

There are three notices:

1. Notice to members in Great Britain who joined the union on or after 1 March 2018 – right to give a withdrawal notice

2. Notice to members in Great Britain who joined the union before 1 March 2018 – right to be exempt from contributing to the fund

3. Notice to members in Northern Ireland– right to give notice to contribute or withdraw from contributions

1. Notice to members in Great Britain who joined the union on or after 1 March 2018 – right to give a withdrawal notice

Under the union’s rules (annex F), members who joined the union after 1 March 2018 must be notified annually of their right to give a withdrawal notice, that is, notice to the union that they are no longer willing to contribute to the political fund and use the Exemption Notice below if they wish to do so.

Notice to Members

Trade Union and Labour Relations (Consolidation) Act 1992 (as amended)

Any member (who joined the union on or after 1 March 2018), who has given notice of their willingness to contribute to the union’s political fund (an ‘opt-in’ notice), has a right to withdraw that notice by giving notice to the union (a ‘withdrawal notice’).

Any member can submit a withdrawal notice:-

(a) by delivering the notice (either personally or by an authorised agent or by post) at the head office or a branch office of the union;
(b) by sending it by e-mail to the following email address: finance@poauk.org.uk
(c) by completing an electronic form provided by the union which sets out the notice and sending it to the union by electronic means with instructions by the union.
(d) by any other electronic means prescribed under the 1992 Act (as inserted by the 2016 Act)

Once this Notice of Exemption is received the union shall process the exemption as soon as reasonably practicable.

2. Notice to members in Great Britain who joined the union before 1 March 2018 – right to be exempt from contributing to the fund

Under the union’s rules (annex F), after the passing of a resolution approving the furtherance of political objects as an object of the union, the following notice must be given to members who joined the union before 1 March 2018:

Any member may obtain exemption from contributing to the political fund by sending a Notice of Exemption to the General Secretary or such other person as is identified in the Notice to Members in rule 1. On receiving the Notice of Exemption, the union shall send an acknowledgement of its receipt to the member at the address in the notice, and shall process the exemption as soon as reasonably practicable.

3. Notice to members in Northern Ireland – right to give notice to contribute or withdraw from contributions

Under the union’s rules (annex F), after the passing of a resolution approving the furtherance of political objects as an object of the union, the following notice must be given to members in Northern Ireland:


The National Executive Committee believe that the Unions Political Fund is a vital tool to allow the Union to campaign more effectively to help protect and promote the interests of the membership, it welcomes the continued endorsement by the membership to retain the Fund and will continue to use it to pressure Government and the Ministry of Justice where ever possible.
